These Terms of Use ("Terms") govern your use of the websites of Y.E.S. — Your Energy Solutions Solar Brokers ("YES Solar Brokers," "we," "us"), including yes4.info and our usage-analysis tool at usage.yes4.info (together, the "Sites"). By using the Sites, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Sites.

Paid services — such as the YES Monitor subscription — are governed by their own service agreements presented at signup, which control over these Terms for those services.

Informational Content, Not Professional Advice

Content on the Sites — including articles, estimates, evaluations, incentive and financing summaries, and savings examples — is provided for general information only. It is not engineering, financial, tax, or legal advice, and it is not a guarantee of system performance, savings, incentive eligibility, or approval. Solar production and savings depend on factors outside our control (weather, rates, equipment, usage). Verify incentive and tax matters with your own advisors.

Usage Evaluations

Our free usage analysis is an estimate prepared from the information and files you provide. You are responsible for the accuracy of what you submit, and you confirm you have the right to share any utility data or documents you upload. Evaluations do not obligate you to purchase anything, and we may decline to prepare an evaluation at our discretion.

Acceptable Use

• Do not misuse the Sites — no unlawful use, no attempts to breach security, scrape at scale, disrupt service, or misrepresent your identity;
• Do not upload content you lack the right to share, or content that is malicious (e.g., malware) or unlawful;
• We may suspend or terminate access for violations.

Intellectual Property

The Sites and their content — text, graphics, logos, images, and software — are owned by or licensed to YES Solar Brokers and protected by law. You may view and print pages for personal, non-commercial use; any other use requires our written permission. "YES Monitor" and the YES Solar Brokers logo are our marks.

Materials You Send Us

When you submit information or files through the Sites, you grant us permission to use them to respond to you and provide the services you request, as described in our Privacy Policy. You represent that you have the right to provide them.

Third-Party Links and Services

The Sites link to third-party websites and services (utilities, installers, financing partners, review platforms). We do not control and are not responsible for them. Your dealings with third parties — including installers we introduce — are between you and them, under their terms.

Disclaimer of Warranties

THE SITES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YES SOLAR BROKERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR ENERGY SAVINGS, ARISING FROM YOUR USE OF THE SITES; AND OUR TOTAL LIABILITY ARISING FROM THE SITES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER CALIFORNIA LAW.

Indemnity

You agree to indemnify and hold YES Solar Brokers harmless from claims arising out of your misuse of the Sites or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for any dispute arising from the Sites lies in the state or federal courts located in Sacramento County, California.

Changes

We may update these Terms from time to time; the "Last updated" date reflects the current version. Continued use of the Sites after changes are posted constitutes acceptance.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
